Shipping & Delivery
In the case of U.K. sales, where goods are to be carried at the cost of DATS (England) Ltd. (DATS) , DATS will bear the risk of loss or damage in transit provided that DATS is notified in writing within 5 (five) working days of dispatch.  In the case of export sales, unless agreed otherwise, Incoterms shall apply and risk of loss or damage to the goods shall pass to the customer in accordance with the terms of the shipping documents.
All claims for the arrival of damaged goods, or missing/short supplied items should be made within 7 (seven) days of delivery.  All claims made after this seven day period will not be considered.
You will be required to pay for delivery charges.  These charges are set out on the website.
We will deliver the goods to the address that you specify for delivery in your order.  It is important that this address is accurate as you will be charged for the shipping if delivery is not possible due to incorrect details.  Most orders will be dispatched within 3 (three) working days after receipt of payment.  If for any reason this is not possible we will contact you with an updated dispatch date.

Returns, Replacements & Cancelations
Should you wish to return an item for a refund or exchange, please do so within 14 days of receipt of your goods.  All goods unless faulty must be returned in a clean and saleable condition and are liable to a handling fee of 15% of the value of the items returned excluding VAT and shipping charges.  All items that are supplied correctly must be returned carriage paid.
You must inform us before you return an item and let us know if you would like a refund or exchange.  Returns are sent at your own expense.  When returning items we recommend that you obtain proof of dispatch from the courier.  We cannot accept responsibility for parcels lost in transit.  We will only refund the carriage costs where the item returned is faulty or has been incorrectly supplied by us.
All body panels and sheet metal parts should be checked for defects and fitment prior to painting, as we cannot accept returns of painted parts or the cost of painting.
You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us [DATS (England) Limited, Bridge House, Weston, Nr. Honiton, EX14 3NZ, United Kingdom, +44 1404 42833 or admin@datsuk.com] of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, or e-mail).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than –

(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us , without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

Ordering
Orders will not be processed until your payment has been received in full.  We accept all major credit/debit cards and PayPal.  We use a secure payment site to take your payment (PayPal).
Once you enter into an order agreement with us, you are agreeing to purchase the goods and allow DATS (England) Ltd to use the personal details that you have given.  These will only be used for the purposes of completing your order.  All personal details are held in accordance with our privacy policy and can be removed from our system by written request. 
Suitability of goods you are purchasing is your responsibility.  We will offer any information or advice available to us to help you ensure that the goods ordered are suitable.  We are not liable if the information given is incorrect to your application.
All orders are subject to availability of stock when processing your order.  Parts listed as "in stock" on the website may be sold instore or over the phone and thus be "out of stock" when you place your order but before the website has been updated.
Payment, Pricing & Promotions
We will take payment upon receipt of your order from your debit/credit card or PayPal account.  We accept no liability if a delivery is delayed bacause you did not give us the correct payment details.  If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you.  This does not effect any other rights we may have.
Orders placed online through our website and all prices are available in Pound Sterling, United States Dollars and Euros.  We accept the following credit and debit cards through PayPal secure servers:  MasterCard, Visa, Maestro, Switch, Solo, Visa Delta and Visa Electron.  Payments can also be made by BACS, postal order, cash and cheque.  Bank details will be supplied on request.  Goods will only be shipped once payment has cleared.
All goods remain the property of DATS (England) Ltd until paid for in full.
We reserve the right to change our prices without prior notification.
We try to give the most competitive price available on the market for all our products, however, if your find a similar part with similar quality we will do our best to match or better the price that you have been quoted.
Warranty
DATS (England) Ltd offers a 12 (twelve) month replacement or refund warranty to the initial purchaser.  The warranty only covers faulty materials or workmanship.  It does not cover wear and tear, lack of scheduled, routine maintenance, incorrect fitment, incorrect application, accidental damage or damage caused by negligence or misuse.  Faulty materials and/or bad workmanship need to be proved and the details notified to DATS (England) Ltd within 12 (twelve) months of invoice date.  The Company will at its own cost and its own option, repair, replace or refund for the faulty item, but subject to this all express or implied warranties or conditions as to quality or fitness for any purpose of the goods are hereby expressly excluded.  It is the responsibility of the qualified installing engineer to check the components specifications before and during installation.  All parts should be installed according to the original equipment manufactureres instructions.  We will not accept liability for consequential loss or loss of profits.
Updating Account Information
To change your account information, click on "My Account" next to the Sign In or Sign Up link at the top of the page.  Once you enter your login information you will be taken to your account page which has a sidebar menu to the left of the screen, under the heading "My Account".
  • To change the way your name appears or your email address, click on the tab in the sidebar menu that says "Account Information"
  • To change your billing or shipping address click on the tab in the sidebar that says "Address Book".  This will bring you to your address page where you will have the option to click on "Edit Address", "Delete Address" or "Add Address".
  • To subscribe or unsubscribe to the DATS newsletter click on the tab in the sidebar menu that says "Newsletter Subscriptions", where you have the option to subscribe or click the box that says unsubscribe.
